During a routine traffic stop of a vehicle in which Alejandro Nunez Nevarez was a passenger, Trooper Gregory Laughlin approached the vehicle and noticed Nevarez bend his entire torso down and then sit back up. After some delay, Laughlin performed a protective pat-down search of Nevarez and found a small gun and package of methamphetamine. Nevarez was charged with one count of an alien in possession of a firearm and one count of possessing methamphetamine with intent to deliver. Prior to trial, Nevarez moved to suppress the evidence, alleging that it was the product of an illegal search. The trial court denied his motion to suppress, finding that the delay was reasonable in light of the troopers safety concerns and convicted him of one count of possessing methamphetamine with intent to deliver.
